Explore General Inc. facing ERISA lawsuit

The Fresno firm Explore General Inc. is facing a civil lawsuit filed by the Department of Labor for violating ERISA.  The Employee Retirement Income Security Act was adopted in 1974 to protect employees covered by private health and pension plans.

The Department of Labor filed the suit in the U.S. District Court for the Eastern District of California accusing the firm’s owner, Jaime Gonzalez, and plan administrator, Paul Gong, of mixing employee contributions with the company’s general assets, and then using the money to pay for company expenses.  The lawsuit claims that Gonzalez and Gong failed to place $70,000 of employee contributions into the 401K fund.
